JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The contention on behalf of the petitioner is that due to communication gap, the petitioner could not surrender before the court of learned Sub Divisional Judicial Magistrate/concerned court, Araria in connection with Complaint Case No. 1221C of 2012 in the light of direction/observation, given by this court in the order dated 26478 of 2015.

However, this Modification petition is allowed and six weeks' more time is granted to the petitioner to surrender before the concerned court in the light of order dated 17-07-2015 passed in Cr. Misc. No. 26478 of 2015 and if, petitioner does so, the concerned court shall proceed with the case in the light of order

Patna High Court Cr.Misc. No.57804 of 2015 (2) dt.13-01-2016 2/2 dated 17-07-2015 passed in Cr. Misc. No. 26478 of 2015. Accordingly, the above-said order dated 17-07-2015 stands modified to the above-said extent.
