JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Aurangabad Town Police Station Case No. 83 of 2011 registered for the offences punishable under Sections 420, 406, 467,468 and 120B of the Indian Penal Code.

The informant originally filed complaint case which was converted into police case. The informant alleged that an agent of OCPL company got enrolled his wife in a policy and took Rs.20,000/- as premium but the informant did not get bond of the concerned company and when he made complaint to higher officials, the higher officials did not pay any heed to the request of

Submission on behalf of the petitioner is that petitioner is not an active member of the concerned company and, as a matter of fact, he has been shown as Board of Directors. Moreover, there is nothing on the record to show that any deposit of the informant's wife was taken by the concerned company. It is also submitted that having more or less similar allegation, some co-accused have already been granted privilege of anticipatory bail by different Benches of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Aurangabad Town Police Station Case no. 83 of 2011, subject to condition as laid down under Section 438(2) of the Cr.P.C.
