The petitioners are apprehending their arrest in connection with Noorsarai P.S. Case No. 47 of 2022 pending in the Court of learned 4th Additional District & Sessions Judgecum-Special Judge Excise-II, Nalanda in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2018.

Allegedly, it is a case of recovery of illicit liquor from the Khalihan of the petitioners.

It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.27348 of 2022(2) dt.04-11-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that the petitioners have clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In view of the fact that the said illicit liquor was recovered from the Khalihan of the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer for anticipatory bail stands rejected.
