2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Later on, section 411 IPC was added.
3. As per the prosecution case, Motor Set of the informant was stolen by some unknown miscreants.
4. It is submitted that petitioner has been falsely implicated in this case on the basis of confessional statement. No stolen article has been recovered from possession of this petitioner. During course of investigation, it has come that the Motor Set in question was purchased by the wife of petitioner from another person without knowing that the same was stolen. Petitioner claims clean antecedents.
5. Considering the facts aforesaid, the petitioner
Patna High Court CR. MISC. No.29308 of 2023(2) dt.17-07-2023 2/2 above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Gopalpur P.S.
