Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 789 of 2021 lodged under sections 302 and 201/34 of the Indian Penal Code.

As per the prosecution case, the marriage of informant's daughter had been solemnized with one Gabbar Manjhi, who received information on 07.09.2021 that his daughter was killed and her dead body was disappeared on the instance of his son-in-law, Gabbar Manjhi.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the petitioner is the brother of the alleged Gabbar

Patna High Court CR. MISC. No.27412 of 2022(2) dt.14-09-2022 2/2 Manjhi. He further submits that petitioner is handicapped and leading his life separately from his brother prior to the said marriage. Learned counsel for the petitioner further submits that his name has figured in this case only and only due to the reason that he is brother of Gabbar Manjhi. In support of his pleadings, he has submitted Annexure-2 which is the doctor's report. He further submits that petitioner is in custody since 11.09.2021 having clean antecedent and charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 789 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
