JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date: 11-07-2018 The present petition has been filed for quashing the order dated 19.03.2009 issued by the Joint Secretary, Road Construction Department, Government of Bihar, Patna, whereby and whereunder the representation of the petitioner for promotion to the post of Superintending Engineer from the date his juniors have been promoted, has been rejected.

I have heard the learned counsel for the petitioner and gone through the records and I find that the person just junior to the petitioner namely Shri Amarendra Narain Sinha was posted on the

Patna High Court CWJC No.18088 of 2010 dt.11-07-2018 2/2 post of Superintending Engineer vide notification dated 08.04.1999 but since the petitioner has retired on 31.03.1999 itself the petitioner could not be granted promotion.

In fact the learned counsel for the petitioner has also failed to show that any person junior to the petitioner has been promoted on the post of Superintending Engineer prior to his retirement on 31.03.1999, hence there is no merit in the present writ petition. Accordingly, the same is dismissed.
