The petitioner apprehends his arrest in Shekhopur Sarai P.S. Case No.89/2017 registered under Sections 135 and 138 of Bihar Electricity Act.

The petitioner is alleged to have committed theft of electric energy even after disconnection of electric connection and it is alleged that the petitioner caused loss of Rs. 27, 176/- by committing theft of electric energy. It is further alleged that Rs. 18, 118/- was lying due against the petitioner and therefore his electric connection was disconnected.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.11533 of 2018 (2) dt.27-02-2018 2/2 petitioner has already deposited Rs. 18, 118/- on 09.04.2017. The petitioner is ready to deposit Rs. 27, 176/- within three months. Considering the aforesaid facts, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Sheikhpura, in connection with Shekhopur Sarai P.S. Case No.89/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. If petitioner fails to deposit Rs. 27, 176/- within three months from today, the learned court below shall cancel the bail bond of the petitioner forthwith after lapse of three months.
