Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown.

Submission is that petitioner is in custody since 15.01.2019. However, he was never put on Test Identification Parade during investigation of the case nor anything was recovered from possession of the petitioner. Similarly situated co-accused Md. Rehan has already been allowed bail by a Coordinate Bench of this Court vide order dated 02.05.2019 passed in Cr. Misc. No. 29209 of 2019.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.31652 of 2019(2) dt.13-05-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Muffasil Police Station Case No. 15 of 2019, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
