The petitioners apprehend their arrest in connection with Brahmpura P. S. Case No. 51 of 2017 instituted under Sections 406,420 and 120B/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The allegation, in brief, is that after fixing marriage, the informant had given Rs. 4 lacs in cash and also incurred expenditure in Ring ceremony, but accused persons retracted from the agreement of marriage as the demand of vehicle was not fulfilled.

No.38988 of 2017 (2) dt.19-08-2017 2/2 Learned counsel for the petitioners submits that there was no need for such monetary transaction infact the informant and the petitioners belong to another caste, so, later on, coming to this fact in the knowledge of the petitioners, they refused to marry. Learned counsel appearing on behalf of the informant submits that mediator was own maternal uncle of the boy and every fact was known to the petitioners' side. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Kunal Verma @ Kunal Kumar, Abhishek Verma @ Abhishek Kumar, Smt. Anita Verma, Smt.

Swapnil @ Dipalika Sabli and Niteshwar @ Nitesh Srivastava, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S.Case No. 51 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
