1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Chaori P.S. Case no. 26 of 2023 registered under sections 392 and 411 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, the informant a driver of the truck stated that three accused persons on a bolero vehicle overtook his truck and on the point of pistol told the informant to hand over the money and mobile phone. However, with the help of police personnel who reached the place of occurrence three persons including the petitioner was caught at the spot and articles recovered.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.31350 of 2024(2) dt.26-04-2024 2/2 earlier prayer for bail of the petitioner was rejected vide order dated 11.10.2023 (Annexure- P/1) passed in Cr. Misc. no. 64225 of 2023 with liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 31.3.2023 and charge-sheet has been submitted in the learned trial Court. The petitioner undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, his not having any criminal antecedent, the liberty granted in the earlier order rejection dated 11.10.2023 and the petitioner having remained in custody for more than 1 year since 31.3.2023, the petitioner is directed to be enlarged on bail in connection with Chaori P.S. Case no. 26 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bhojpur at Ara.
