JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2017 Heard the parties.
This application, for grant of anticipatory bail, arises out of Suryagarha P.S. Case No. 124 of 2017, disclosing offences under Sections 147, 148, 149, 447, 337 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Patna High Court Cr.Misc. No.42880 of 2017 (2) dt.19-09-2017 2/3 Learned counsel for the petitioners has submitted that the informant of the case is accused of offence punishable under Section 302 and other sections of the Indian Penal Code in Suryagarha P.S. Case No. 123 of 2017, registered on the same day. He has submitted that out of retaliation, the present case has been lodged, implicating these petitioners and others.
On perusal of the First Information Report, I find that there is allegation against the petitioners of opening fire, but there is no allegation of injury, which is said to be caused on the person of anyone, as a result of the said firing.
Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Suryagarha P.S. Case No. 124 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the
Patna High Court Cr.Misc. No.42880 of 2017 (2) dt.19-09-2017 3/3 police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
