The petitioner apprehends his arrest in Ghorasahan (Lakhaura) P.S. Case No. 263 of 2014 under sections 379, 380, 457 and other sections of the IPC.
The informant alleged that the petitioner and others entered into her house, dragged her out from the house and tied her in a bamboo. The accused persons took away valuable articles from her house.
The learned counsel for the petitioner submits that the petitioner was not present at the place of occurrence but there is nothing on record to substantiate the plea of alibi of the petitioner. The informant herself has alleged that the petitioner also assaulted
Patna High Court Cr.Misc. No.43629 of 2017 (2) dt.20-09-2017 2/2 and dragged her out from the house and after tying her in a bamboo this petitioner and others took away valuable articles of house.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
