The petitioner apprehends his arrest in Barauni P.S. case No.227 of 2016 under Section 47 of Bihar Excise Amendment Act, 2016.

The informant alleged that on secret information 10 bottles of Royal Stag Whisky, each containing 750 ml., were recovered from a ditch situated behind Bharat Gas Agency. It is alleged that the premises belongs to the petitioner. The learned counsel for the petitioner submits that petitioner had no knowledge about keeping of bottles in the ditch. Considering the facts aforesaid and the fact that 10 bottles of Royal Stag Whisky were recovered from a ditch and not
