JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Garkha P.S. Case No. 43 of 2019, registered for offences punishable under Section 25(1-b)a/26 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country made pistol.
It has been submitted on behalf of the petitioner that he has been made the victim of high handedness of the police as the petitioner was accused in one more case, in which, this court had granted the petitioner interim protection but without appreciating the same, police arrested him and when explanation was asked by the court below, the police has falsely implicated the petitioner in this case and he has been in judicial custody for last three months and now chargesheet has been submitted.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Garkha P.S. Case No. 43 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
