2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191(2)(3), 190, 115(2), 351(2)(3), 132, 223, 352, 324(4)(5), 61(2) of the Bharatiya Nyaya Sanhita and Sections 3⁄4 of Prevention of Damage of Public Property Act.

3. As per F.I.R., on the alleged date and time of occurrence, all the named accused persons, including this petitioner, leaving the designated route for immersion of Kali idol entered through different route by creating ruckus. They also broke the barricade and tried to go ahead.

4. It is submitted on behalf of the petitioner that the petitioner is innocent and has committed no offence. The allegation levelled against petitioner is general and omnibus and

Patna High Court CR. MISC. No.26434 of 2026(2) dt.11-05-2026 2/2 no specific overt act is alleged against him. Similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 19.02.2025 passed in Cr. Misc. No. 3471 of 2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Tilka Manjhi P. S. Case No. 210 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
