JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 The present application has been filed for modification of the order dated 21.03.2012 passed in Cr. Misc. No. 8558 of 2012, whereby the petitioner was granted anticipatory bail on readiness of the petitioner to deposit Rs. 24,000/- within a period of three months before learned Court below and till then the bail bond of the petitioner was to be accepted provisionally.

It is submitted by learned counsel for the petitioner that bail bond of the petitioner was accepted provisionally but the petitioner failed to deposit Rs. 24,000/- within the time limit.

This Court is not inclined to modify the order after more than three years of its passing.

Let learned Court below consider the prayer for regular bail of the petitioner and disposed of the same preferably on the same day, if the petitioner surrenders within

Patna High Court Cr.Misc. No.57810 of 2015 (2) dt.11-01-2016 2/2 a period of six weeks and deposits Rs. 24,000/- before learned Court below.

Accordingly the modification application is disposed of in connection with Sandesh P.S. Case No. 94 of 2011, pending in the Court of learned Chief Judicial Magistrate, Bhojpur at Ara.

Hence the order dated 21.03.2012 passed in Cr. Misc. No. 8558 of 2012 is rescinded.
