Petitioner apprehends arrest in connection with Patory (Mohanpur O.P.) P.S. Case No. 37 of 2017 registered under Sections- 304B and 201/34 of the Indian Penal Code pending in the Court of C.J.M., Samastipur.

Learned counsel for the petitioner submits that petitioner, who happens to be husband of the deceased, is innocent and has falsely been implicated in this case. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner. During the course of investigation, witnesses have also supported the prosecution case.

No.35989 of 2017 (3) dt.01-09-2017 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner.
