JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code.

As per prosecution case, from early in the morning on 30.10.2015, grandson of the informant was missing and later on, his dead body was found lying by the side of the railway line and name of the petitioner has come in course of investigation. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He is not named in the F.I.R. Subsequently, in course of investigation the mother of the deceased is said to have taken the name of the petitioner. From perusal of the F.I.R. it appears that she is a witness to the F.I.R. and she had not disclosed the name of the petitioner at the time of institution of the F.I.R. itself.

On behalf of the State, it is submitted that though petitioner is not named in the F.I.R. but has actively participated in the alleged occurrence.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.56511 of 2015 (4) dt.02-03-2016 2/2 above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case no. 347 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
