JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Kotwali P.S. Case No. 337 of 2013 registered for the offence punishable under sections 302/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner and the informant are resident of the same Mohalla and they were in talking terms with eachother. Petitioner had made call only to know the whereabouts of the deceased. Petitioner has no criminal antecedent.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there was no occasion for the petitioner to call on the mobile of the sister of the deceased to inquire about the deceased. Materials have come during investigation to suggest involvement of this petitioner in the

Patna High Court Cr.Misc. No.41915 of 2017(5) dt.09-11-2017 2/2 alleged offence.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
