2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b) a, 26 and 35 of the Arms Act.

It is a case of recovery of incriminating weapons from the possession of co-accused persons.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He has falsely

Patna High Court CR. MISC. No.30559 of 2024(3) dt.25-06-2024 2/3 been implicated in the present case due to dirty village politics. His name transpired on the basis of confessional statement of apprehended co-accused namely, Akabar @ Pinki, Md.

Hussain and Dipu Kumar. The petitioner has no concern with alleged recovery and other coaccused persons. Neither the petitioner was arrested on spot nor any incriminating article has been recovered from his conscious possession. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

6. Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on anticipatory bail in connection with Nanpur P.S. Case No. 426 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)
