====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 06.04.2020 in connection with Dagaruwa P.S. Case No. 50 of 2020 registered for the offences punishable under Sections 20/22/24 of the of the Narcotic Drugs and Psychotropic Substance Act. As per the prosecution case, 15 grams of Brown Sugar has been recovered from the possession of the petitioner. It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case and there is no compliance of mandatory provisions of search and seizure. The alleged quantity comes within the category of small quantity. It is further submitted that other co-accused persons have already been granted bail and charges-sheet has already been submitted.
