2 The petitioner apprehends arrest in connection with Kateya PS Case No 44 of 2022 dated 02.02.2022 instituted under Sections 341, 323, 504, 506, 498A/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. 3 The allegation is against the family members of the petitioner that they assaulted the informant and ousted her from the matrimonial home due to non-fulfillment of demand of dowry.
4 The learned counsel for the petitioner submitted that though the petitioner is the husband of the informant, he is not
Patna High Court CR. MISC. No.30132 of 2024(2) dt.20-05-2024 2/2 named in the FIR. During the course of investigation, the petitioner has also been made acused in this case. It is further submitted that petitioner has one case against him. 5 Learned APP has opposed the prayer for bail. 6 Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Kateya PS Case No 44 of 2022 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure, 1973. 7 The application stands allowed.
