2. Petitioner seeks regular bail in connection with Raghopur P.S. Case No. 244 of 2023 dated 13.10.2023 in a case registered for the offences punishable under Sections 304B & 201 / 34 of the Indian Penal Code.

3. It is a case of dowry death. It is alleged that this petitioner along with other FIR named accused persons committed murder of the daughter of the informant for dowry. Petitioner is the husband of the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. FIR in the present case has been lodged after a delay of three days and there is no explanation for the said delay. He further submits that petitioner has not committed any torture or demanded dowry, rather the deceased died her natural death. He further

Patna High Court CR. MISC. No.26681 of 2025(2) dt.27-06-2025 2/2 submits that on the date of occurrence, this petitioner along with his brother Upendra Ray was working as labourer under contractor at Patna. He further submits that the dead body of the deceased was found by Police at Kurtha Ghat, the information was given to the Police and dead body was recovered on 13.10.2023 and as per inquest report, no any sign of assault on the body of the deceased was found and it appears that the deceased was not done to death by some other person. Petitioner is in custody since 04.10.2024.

Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner is husband of the deceased and there is direct allegation against him of demand of dowry and torture. During the course of investigation informant and witnesses have supported the case of prosecution. The dead body was recovered at the river bank in village Raghopur West. The post-mortem report mentions the cause of death was asphyxia due to strangulation.

6. Considering the facts and circumstances of the case as well as the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shahnawaz/- U T
