JUSTICE SUDHIR SINGH ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner no. 1 and learned counsel for the State.

The present application has been filed for modification of the order dated 02.05.2016, passed in Cr. Misc. No. 15506 of 2016, by which the petitioner no. 1 was granted provisional anticipatory bail and petitioner nos. 2, 3 and 4 were granted anticipatory bail in connection with Samastipur (M) P.S. Case No. 403 of 2014, pending in the court of learned S.D.J.M., Samastipur, and the petitioner no. 1 was directed to deposit an amount of Rs. 4,00,000/- within a period of four months in the court below which shall be released in favour of the informant. It has been submitted on behalf of learned counsel for petitioner no. 1 that the petitioner no. 1 has already deposited Rs.

Patna High Court Cr.Misc. No.37950 of 2016 (2) dt.31-08-2016 2/2 1,50,000/- out of Rs. 4,00,000/- in compliance to the aforesaid order. He seeks further four months time to deposit the balance amount of Rs. 2,50,000/- in the court below.

The period of provisional anticipatory bail granted to the petitioner no. 1, vide order dated 02.05.2016, passed in Cr. Misc. No. 15506 of 2016, for depositing the balance amount is extended by another four months. Within the said period, the petitioner no. 1 shall deposit the balance amount of Rs. 2,50,000/-. Once, the balance amount is deposited within the said period, the provisional bail granted to the petitioner shall be confirmed by the court below.

The order dated 02.05.2016, passed in Cr. Misc. No. 15506 of 2016, stands modified to the extent as indicated above. The present modification application is, accordingly, disposed of.
