The present petition has been filed seeking the following relief :- "(i) For issuance of appropriate writ, order, direction to the respondents to consider and appoint the petitioner on the post of Constable under General Category against the Advertisement no. 1/2012, published by the respondent no.4"

The learned counsel appearing for the Central Selection Board of Constables has submitted by referring to the counter affidavit filed in the present case that the petitioner

Patna High Court CWJC No.24693 of 2013 dt.06-07-2023 2/2 being a General Male Non-Home Guard category candidate has secured lesser marks than the last candidate selected in his category. It is further submitted that while the petitioner has secured 186 marks, the cut- off marks in his category is 189 marks, hence, the petitioner has got no case at all for being appointed on the post of Constable since he is having lesser marks in his category than the marks obtained by the last candidate appointed on the post of Constable, in pursuance to the advertisement in question.

Having regard to the facts and circumstances of the case and the specific averment made by the respondent- Central Selection Board of Constables to the effect that the petitioner has got lesser marks than the cut off marks in his category, I do not find any merit in the present writ petition, hence, the same stands dismissed.
