The petitioner seeks bail in Siwan Mufassil P. S. Case No. 253 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code. In the written report it is alleged that brother of the informant had gone with Bablu Natt and Guddu Natt and on next day the informant received information that dead body of his brother was lying on the road near Hero Agency. The girl, namely, Manisha Khatoon, disclosed that this petitioner and other accused persons came on motorcycle and have committed the occurrence.
From the written report, it appears that aforesaid Manisha Khatoon has not stated anything about commission of
Patna High Court CR. MISC. No.28639 of 2019(2) dt.02-05-2019 2/2 the occurrence. She has only stated that she has found one dead body lying on the road.
The petitioner is in custody since 10.11.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Siwan in connection with Siwan Muffasil P. S. Case No. 253 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
