JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Trial No. 2224 of 2018, arising out of C.R. Case No. 370 of 2016 (CIB) 419/2016 (C-R), disclosing offence under Sections 420/34 of the Indian Penal Code.

Complaint petition disclosed that the petitioner approached the informant and on false pretext of providing job, taken money and complaint petition disclosed that in the bank account of the petitioner Rs.5,50,000/- has been transferred and several other transactions are there, but in the name of other accused persons. Submission of learned counsel for the petitioner is that the amount which has been deposited in his bank account, i.e. Rs.25,000/-.

Heard learned APP as well as learned counsel for the opposite party no.2 also.

No.26064 of 2019(3) dt.05-07-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, appear before the learned court below by 31.07.2019 with a bank draft of Rs.25,000/- payable in the name of Sanjiv Kumar and once the same is deposited, provisional bail granted to the petitioner vide order dated 22.04.2019 shall be confirmed.

It is also made clear that if any, application is filed for release of the money, the same shall be released in favour of Sanjiv Kumar on his filing undertaking before the learned court below. With the aforesaid observations, this application is disposed of.
