JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution case as lodged by the informant is that when he proceeded for group collection and after the collection he was standing at the house of Farjana Khatoon, then a person put pistol on his head and directed to give cash amount. Upon protest, two persons armed with pistol came and took out total Rs. 49,780/- from his pocket along with golden ring, a bag in which there was a register, a HHD machine and two mobile phones.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this
Patna High Court CR. MISC. No.27819 of 2020(3) dt.14-12-2020 2/2 case. He submits that no incriminating article has been recovered from the possession of the petitioner and no TIP has been done as yet. He further submits that petitioner is languishing in judicial custody since 25.02.2020. In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected at this stage in connection with Mojahidpur (Babarganj) P.S. Case No. 170 of 2019 pending before the court of the learned Chief Judicial Magistrate, Bhagalpur.
