The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 406, 409, 467, 468, 471, 120B/34 of the Indian Penal Code.

Allegation is of financial embezzlement in the government scheme for installation of street-lights etc. It is submitted on behalf of petitioner that petitioner has been made accused in this case merely because he is son of ex-Mukhiya. He was neither the agent nor the office-bearer of the Gram Panchayat. He is nowhere involved in the alleged scheme. Similarly situated co-accused Prem Sagar Mishra, who was the then B.D.O., has already been granted anticipatory bail by this Court, vide order dated 16.11.2021 passed in Cr.Misc. No. 11061 of 2021.

Patna High Court CR. MISC. No.27396 of 2022(2) dt.14-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Matihani P.S. Case No. 121 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
