1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in Siwan (Chainpur O.P.) P. S. Case No.163 of 2022 registered for the offences punishable under Sections 147, 148, 149, 141, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case. It is next submitted that there is admitted land dispute in between the parties and from the side of the petitioner also, a criminal case and a title suit was instituted against the side of the informant.
4. Learned A.P.P. opposes the anticipatory bail
Patna High Court CR. MISC. No.34983 of 2023(3) dt.13-02-2024 2/2 application and submits that there is specific allegation against the petitioner of assaulting with farsa causing injury to the injured and the injury is said to be grievous. It is next submitted that even if any Title Suit is pending between the parties that definitely does not entitle the petitioner to use such force causing grievous injury.
5. Considering the submissions made by the learned Additional P. P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
6. Accordingly, the prayer of anticipatory bail application of the petitioner stands rejected. (Satyavrat Verma, J) vikash/- U T
