====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2023 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.
3. It is alleged that these petitioners fabricated and forged documents in order to grab the house and other properties of the informant impersonating as legal heirs of Late Rama Shankar Prasad.
4. It is submitted that it is purely a civil dispute. There
Patna High Court CR. MISC. No.28890 of 2023(2) dt.17-07-2023 2/2 is a title suit pending between the parties bearing No. 314 of 2019 in which petitioners and informant both are parties and court therein had restricted the parties from selling off the suit properties. Irrespective of that, the informant sold the suit properties and lodged this false and fabricated case against the petitioners. Case and counter case. It is further submitted that F.I.R. has been lodged after delay of nine years and no explanation has been given by the informant, that itself makes the case doubtful. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P. S. Case No. 603 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
