The petitioner is apprehending his arrest in connection with Nimachanpura P.s.Case No.23 of 2018 , registered for offences punishable under Sections 302, 364, 201/34, 364 of the Indian Penal Code.

Prosecution story is that one Kavita Devi was traceless and nobody has been made accused in the FIR and later on name of the petitioner transpired during the course of investigation.

Submission of the learned counsel for the petitioner is that the name of the petitioner transpired in the re-statement of the informant though the informant has not named this petitioner in the FIR. Furtehr submission is that the petitioner apprehends that there was illicit relationship with the husband

Patna High Court CR. MISC. No.26371 of 2019(4) dt.08-07-2019 2/2 of Khushbu and Kavita Devi, as such he apprehends hands of Khushbu and further as there was money transaction between Md. Alam who has taken money from Kavita Devi, as such he apprehends the hands of the husband of Khushbu might have caused the death along with the other accused persons and except suspicion there is nothing against the petitioner. Heard learned A.P.P. , who has opposed the prayer for bail..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Begusarai in connection with Nimachandpura P.S.Case No.23 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
