2. This writ application has been filed for setting aside order passed in Misc. Case No. 02 of 2021-22 by the D.C.L.R., Kishanganj.

However, after some argument, learned counsel for the petitioner requests for disposal of the writ petition with liberty to the petitioner to file fresh representations before the Divisional Commissioner, Purnea / competent authority for restoration of Appeal No. 55 of 2014, which stood dismissed for default on 17.05.2017.

4. In view of limited prayer made on behalf of petitioner, the writ petition stands disposed of with liberty, as indicated above.
5. It goes without saying that if any question of limitation arises before the authority concerned, the same shall be considered taking into consideration the fact that the petitioner was pursuing the issue before this Court under Article 226 of the Constitution of India.
6. With aforesaid direction, the writ application stands disposed of.
