Petitioner is in custody in connection with Sasaram (Town) P.S. Case No. 412 of 2018 for the offence under sections 395, 397 and 412 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that name of the petitioner surfaced on the basis of confessional statement of co-accused and nothing was recovered from the possession of the petitioner to implicate the petitioner in the commission of crime.
Learned counsel for the petitioner submits co-accused who disclosed the name of the petitioner has been granted bail and also the persons from whose possession incriminating
Patna High Court CR. MISC. No.27629 of 2019(2) dt.26-04-2019 2/2 articles were seized have also been granted bail. The petitioner is in custody since 28.2.2019. Considering the aforesaid facts and circumstances, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram Town P.S. Case No. 412 of 2018.
