Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 208 of 2022 lodged under Sections 8(C), 21(b), 27(A), 29 of the N.D.P.S. Act.

The allegation as per the F.I.R. is that the petitioner has found in possession of 27 puriya of heroin, total 32.840 gm from his possession.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits that the total recovery is much less than the commercial quantity.

No.27406 of 2022(2) dt.14-09-2022 2/2 Learned counsel for the State opposes the prayer for bail and submits that small quantity is 5 gm and petitioner found in possession of 6 times more than small quantity. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but he may renew his prayer for bail one year after framing of charge in this case.
