====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 307, 504/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, due to land dispute, petitioner and other accused persons abused and assaulted the informant side. In the meantime, co-accused Binay Kumar fired upon the informant.
4. Learned counsel appearing for the petitioner submits that the specific allegation of firing is against coaccused Binay Kumar and petitioner is only alleged to be present on the spot. There is no allegation of committing overt against the petitioner. Informant is brother-in-law of the petitioner. Petitioner is a lady and claims clean antecedent.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.36337 of 2024(6) dt.24-02-2025 2/2 for bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Ahiyapur Police Station Case No. 251 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
