The petitioner is apprehending his arrest in connection with Vaishali P.S. Case No. 175 of 2014 for the offences instituted under Sections 341, 323, 307, 379 and 504/34 of the IPC. As per the prosecution case that the accused persons were cutting the tree of Imli situated in the land of informant and when the informant protested, accused Bindeshwar Singh caught hold her hair and torn her blouse and assaulted with bamboo, when her husband Raghuvir Singh came to rescue, petitioner assaulted with garasa on his hand due to which her husband fell down and became unconscious and also took away Rs.18000/- from the pocket of the informant.
Patna High Court Cr.Misc. No.58228 of 2015 (2) dt.09-03-2016 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The case has been instituted after fifteen days of the occurrence. There is no medical report to support the allegations made in the FIR. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Vaishali P.S. Case No. 175 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
