2. The present writ petition has been filed with the following reliefs:- I. Issuance of appropriate writ / order quashing the order dated 08/03/2025, passed in Miscellaneous Case No. 7 of 24-25, by DPO, ICDS, Siwan where by the appointment of petitioner on the post of Anganwadi Sevika has been found illegal and the CDPO, Siwan is directed to advertise the post afresh.

II. Issuance of appropriate writ /order/direction directing the respondent authorities to reinstate the petitioner on the post of Anganwadi Sevika on which she was selected and appointed and worked till her appointment was

Patna High Court CWJC No.7541 of 2025(2) dt.02-04-2026 2/2 cancelled by the order of DPO, Siwan dated 17/05/2022.

Issuance of appropriate writ/direction directing the respondent authorities to make payment of her wages from 20/03/2022 up to now.

Learned counsel for the State, on the other hand, raised preliminary objection and submits that by virtue of filing the present writ petition, the petitioner has challenged the order passed by D.P.O. directly before this Hon'ble Court. He further submits that under the Margdarshika Rule of Anganwadi Sevika/Sahayika, the order passed by the DPO is always challengeable before the Appellate Authority.

In the light of the submissions made, the present writ petition is hereby disposed off granting liberty to the petitioner to avail his remedy before the appellate forum within 30 days from today and the Appellate Authority shall decide the appeal of the petitioner within 90 days after appearance of all private parties, if any.

5. Delay, if any, in filing the appeal is hereby directed to be condoned.
