The petitioner apprehends her arrest in connection with Malsalami P.S. Case no. 212 of 2015, registered under Section 302 of the Indian Penal Code.

The allegation of informant Manish Kumar Goswami is that the marriage of his sister, namely, Manisha Goswami was performed with Ravi Goswami in the year 2012 and there is two children born out of their wedlock. The Sister of the informant Manisha Goswami was a teacher in a school and her husband used to ask her leave the job, but she was not ready to leave the job of teacher. On 12.09.2015 informant along with his mother and father went to the house of his sister and on the next morning his sister was dashed from the roof and hurriedly she was rushed to the Laxmi Shree Nursing

Patna High Court Cr.Misc. No.2512 of 2017 (2) dt.03-03-2017 2/2 Home at Gulzarbagh for treatment by the husband of the deceased, sister of the informant.

Learned counsel for the petitioner submits that petitioner is the mother-in-law of the deceased and she is not named in the F.I.R. In course of investigation, in supervision note, it has come that this petitioner had made demand of dowry while the informant, who is the brother of the deceased has not whispered about demand of dowry in his fardbeyan, which is the basis of the F.I.R. The petitioner is a lady aged about 75 years.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Malsalami P.S. Case No. 212 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
