2. The petitioner seeks bail in connection with Khagaria P.S.Case No.207 of 2022 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. It has been submitted by the learned counsel for the petitioner that petitioner is a lodge owner and he has falsely been implicated in the instant case.

4. Earlier the prayer for bail of the petitioner was rejected.

5. The criminals have stayed in his lodge but he has

Patna High Court CR. MISC. No.30357 of 2024(5) dt.13-09-2024 2/3 no role in the loot. He is in jail since 07.04.2022 and having clean antecedent. He also submits that charges have been framed but no witnesses have been examined.

6. Considering the period of custody and no role of the petitioner in the loot as has been argued by the learned cousnel for the petitioner, this application is allowed.

7. Let the above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-V, Khagaria in Khagaria P.S.Case No. 207 of 2022.

8. After being released on bail, the petitioner is directed to stay at Nehru Vihar, Timarpur Delhi, P.S- Wazirabad, Pin- 110054 under the care of Rita Devi.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Wazirabad Police Station on 1st and 3rd Sunday of every month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner. He may appear through his counsel, in the trial on the date fixed, virtually from Delhi where he seeks to stay during trial. One of the bailors should be the mother of the petitioner.
