JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Lakhisarai Kabaiya P.S. Case No. 277 of 2020 for offences under Section 448, 341, 323, 504, 307, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioner have no criminal antecedents. Learned counsel further submits that the petitioners and informant are agnates and they are running Sattu-Bhuja shop, and as a matter of business rivalry, the present incident took place.

Considering the aforesaid, the Court is inclined to

Patna High Court CR. MISC. No.23304 of 2020(3) dt.11-01-2021 2/2 grant the privilege of anticipatory bail to the petitioners subject to the condition that the petitioners have to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai Kabaiya P.S. Case No. 277 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of Lakhisarai Kabaiya P.S. Case No. 277 of 2020.
