JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-01-2021 The present petition has been filed for restoration of the petition bearing Criminal Misc. No. 2040 of 2020 which was dismissed for non-prosecution by a coordinate Bench of this Court vide order dated 26.02.2020.

The learned counsel for the petitioner has submitted that on account of unforeseeable events he could not appear before this Court, hence the present petition was dismissed on account of non-prosecution.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to direct for restoration

Patna High Court CR. MISC. No.6925 of 2021(2) dt.27-01-2021 2/2 of the aforesaid petition bearing Criminal Misc. No. 2040 of 2020 to its original file.

The present petition stands allowed.
