Counsel for the State and Mr. Yogendra Prasad Sinha, counsel for the private respondents have appeared and submit that by the announcement of fresh Panchayat Election-2016 the matter has been rendered infructuous inasmuch as the petitioner, an Ex Up-Pramukh of Panchayat Samiti, Barari in the District of Katihar has raised his grievance against the 'No Confidence Motion' passed against him in the year 2013. It is submitted that since the fresh elections have already been announced hence the issue raised has become academic and considering the submissions, the writ petition is accordingly disposed of as having become infructuous by passage of time.
