JUSTICE MIHIR KUMAR JHA ORAL JUDGMENT 11-02-2015 Heard learned counsel for the parties as with regard to the following relief prayed in this writ application:- "For direction to the respondent no. 3 to appoint the petitioner on the post of Peon-cum-Night Guard in the Bihar Education Project, Darbhanga on the ground of his final selection in terms of the advertisement dated 03.11.2013 published in the daily newspaper, 'Hindustan' Hindi edition (Annexure-'1').

2. In view of the clear stand taken in the counter affidavit at para-8 that there were only two posts for Peon in the Scheduled Caste category out of total appointment of 14 peons and that two candidates, who were selected and appointed, had secured 56 and 55 marks respectively in the process of selection as against the petitioner, also

Patna High Court CWJC No.6762 of 2014 (2) dt.11-02-2015 2/2 belonging to Scheduled Caste category getting only 35 marks, there will be no difficulty now in coming to the conclusion that no error has been committed by the respondents in not selecting and appointing the petitioner on the post of Peon in Bihar Education Project, Darbhanga.

3. That being so, this writ application fails and is, accordingly, dismissed.
