This is an application for grant of anticipatory bail in connection with Charpokhari P.S. Case No. 173 of 2017 registered for the offence punishable under Sections 392, 395 and 412 of the Indian Penal Code.

The case of the prosecution is regarding unknown accused persons having intercepted the informant of the present case and having snatched money bag from him.

The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor the petitioner has been apprehended from the spot, however, his name has transpired during the course of investigation when the Police had raided the house of co-accused Rahul Kumar and

Patna High Court Cr.Misc. No.10561 of 2018(2) dt.22-02-2018 2/2 Kush Kumar and recorded their confessional statement. It is further submitted that similarly situated co-accused person has already been granted bail by an order dated 17.10.2017 passed in Criminal Misc. No. 49459 of 2017. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 173 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
