2. Petitioner apprehends his arrest in connection with Chandradeep P.S. Case No. 53 of 2023 registered for offences under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, on 26.03.2023 while the informant was returning to his village, Haidra from Aliganj market on his Apache bike, he was intercepted by the petitioner and one another co-accused person, namely, Pintu Yadav who looted his motorcycle and also snatched gold chain from his neck. He was also abused and roughed up.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.32211 of 2024(2) dt.21-05-2024 2/2 present case due to oblique motive. It is further submitted that no incriminating article has been recovered from the possession of the petitioner or from his house. Petitioner has got two criminal antecedent in which he is on bail.

5. Having considered the above facts and circumstances of the case and the petitioner has got two criminal antecedent out of which one is of similar nature like the present one which shows that the petitioner is a habitual offender, prayer for anticipatory bail of the petitioner is, hereby, dismissed.
