JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with S.Tr. No. 406 of 2022 arising out of Ratanpura P.S. Case No. 27 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 28.03.2023 and there is recovery of 648 litres of Dilwale Shofi Nepali Country made liuor from his possession and he has five antecedents.

Learned APP has vehemently opposed the prayer of bail.

Patna High Court CR. MISC. No.27954 of 2023(2) dt.15-05-2023 2/2 Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Court No. 2, Supaul in connection with S.Tr. No. 406 of 2022 arising out of Ratanpura P.S. Case No. 27 of 2022.

The petitioner will visit Ratanpura Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
