ANJANA MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Dumra P.S. Case No.243 of 2013 for allegedly having committed the offence under Sections 420, 409, 467, 468 and 471 of the Indian Penal Code. The allegation against the petitioner as reported by the Block Development Officer, Dumra, Sitamarhi is that the petitioner being an Executive Assistant of Paddy Adhiprapti Kendra, Dumra along with one Shyama Kant Chaudhary had committed irregularities in the purchase of paddy. Learned counsel for the petitioner submits that though the allegation against the petitioner is of having committed irregularities, in the report it has not come that at

Patna High Court Cr.Misc. No.58173 of 2015 (3) dt.06-05-2016 2/2 the Kendra managed by the petitioner, paddy measuring 42970.67 quintals were purchased by the petitioner and there were irregularities committed by the petitioner in the purchase of the same. Learned counsel for the petitioner has also brought on record a copy of the order dated 19.5.2014 passed in Cr.Misc. No.14866 of 2014, wherein this Court has been pleased to extend the privilege of anticipatory bail to coaccused Shyama Kant Chaudhary.

In view of the aforementioned facts and circumstances and that similarly situated co-accused has been granted the privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No.243 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
