Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341,323,337,338,307,504/34 of the IPC and section 27 of the Arms Act.

As per the prosecution case, on account of dispute over construction of drainage, simple marpit took place between the parties. This petitioner along with other accused persons are alleged to have assaulted the informant, his minor son and other relatives. It is also alleged that they took away ornaments and cash.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.27354 of 2022(2) dt.14-11-2022 2/2 this case. There is no specific allegation of commission of assault against this petitioner and injury sustained by the injured has been found to be simple in nature. Petitioner is a lady and has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-VIII, Saran at Chhapra in connection with Chhapra Mufasil P.S. Case No. 51/2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
