The petitioner apprehends his arrest in connection with Complaint Case No. 2303 of 2014, registered under Sections 498(A), 406 and 323 of the Indian Penal Code.
The accusation is of torturing of the complainant due to non-fulfillment of demand of motorcycle and cash of Rs. 50,000/- by her husband and other in-laws and also to remove her from her matrimonial house giving threatening to perform re-marriage of her husband.
Learned counsel for the petitioner submits that petitioner is husband of the complainant has filed the Matrimonial Case No. 271
Patna High Court Cr.Misc. No.19078 of 2017 (4) dt.04-08-2017 2/2 of 2012 on 30.07.2012, but complainant did not appear before the trial Court and ex parte Judgment has been passed on 19.01.2017, but only to give undue pressure, the wife of the petitioner (complainant) filed the present case.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Saran at Chapra in connection with 2303 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
